Refund, Cancellation and Payment Policy
Version 1.0 · Effective [date — pending SKEPTIX] · Forms part of the SKEPTIX Terms and Conditions
Please Read This Before Paying
This Policy explains what you pay, when you pay it, and in what circumstances money is or is not returned. It forms part of our Terms and Conditions. By paying any advance to SKEPTIX, you confirm that you have read and accepted this Policy.
The core position in one line: SKEPTIX builds software to your written specification. Once that work has been performed, the fee for it is not refundable.
1. General Principles
1.1 Why work-based fees are not refundable. Everything SKEPTIX supplies is either bespoke work built to your own written brief, or digital software delivered immediately. Once development time has been spent, it cannot be recovered or resold. Once a digital file has been delivered, it cannot be returned. Our pricing reflects this.
1.2 Written Scope governs. Before any development begins, SKEPTIX issues a written Scope describing exactly what will be built and delivered, and a fee. You confirm it in writing. The Scope is the definitive statement of what you are paying for. Refunds, disputes and acceptance are all assessed against the Scope, not against expectations that were never written down.
1.3 Fixed price. The fee stated in an accepted quotation is fixed for the Scope stated in it. SKEPTIX will not increase that fee later for the same Scope. Equally, work outside that Scope is not included in it.
1.4 No performance basis. SKEPTIX makes no promise, guarantee, assurance or representation of profit, return, accuracy, success rate or any trading outcome. No refund is available on the ground that a product did not produce a profit, a result, or any other benefit, because no such result was ever promised, and none could be.
1.5 What is always refundable. If SKEPTIX cancels an engagement for any reason other than your breach, or is unable to deliver at all, SKEPTIX refunds all sums paid for work not performed.
1.6 Statutory rights preserved. Nothing in this Policy removes any right you have that cannot be excluded by agreement — including rights under Indian consumer protection law, and, for consumers in the European Union and United Kingdom, the rights described in Clause 5.
Part A
India Track — Custom Analytical Indicators
Applies to custom charting indicators built for Indian markets, supplied for educational, analytical, study and demonstration use.
2.1 Payment Schedule
| Stage | Amount | When |
|---|---|---|
| Advance | 50% | On confirmation of the written Scope, before development begins |
| Balance | 50% | On delivery of the completed indicator, before final files are released |
2.1.1 Development does not begin until the advance is received and the Scope is confirmed in writing. Final files and any platform access are released only after the balance is received.
2.2 Refund Position
2.2.1 The 50% advance is non-refundable once development has commenced. It compensates capacity reserved and work already performed.
2.2.2 No refund is available after the indicator has been built and delivered.
2.2.3 No refund is available on any of the following grounds: you changed your mind, changed your method, or no longer need the indicator; you did not obtain any particular outcome, benefit or result from using it; you were unable or unwilling to install, configure or use it; your platform subscription, data feed or device was inadequate; you decided to use a different tool instead; or you did not read the Scope carefully before confirming it.
2.2.4 What we do instead of refunding. If the delivered indicator does not display what the confirmed Scope says it will display, SKEPTIX will correct it at no charge (Clause 2.3). Correction, not refund, is the remedy for a defect.
2.2.5 If SKEPTIX cannot build it. If, after accepting the Order, SKEPTIX finds it cannot build the indicator substantially in accordance with the confirmed Scope, and cannot resolve this within a reasonable period, SKEPTIX will refund the advance less a reasonable charge for work already performed, and will explain in writing what that charge covers.
2.2.6 Cancellation before development begins. If you cancel in writing before development has commenced, SKEPTIX refunds the advance in full, less any payment gateway or transfer charge already incurred.
2.3 Correction, Not Refund
2.3.1 You have 7 days from delivery to check the indicator against the confirmed Scope and to report, in writing, anything it does not display as specified.
2.3.2 SKEPTIX corrects genuine defects free of charge, as many times as necessary, until the indicator matches the confirmed Scope.
2.3.3 A defect means a failure to display what the Scope says. It does not mean a preference for a different appearance, a change to the rules you originally supplied, or a request to alter the tool with a view to changing outcomes.
2.4 No Performance Discussion on This Track
2.4.1 SKEPTIX does not publish, supply, discuss or rely upon any profit figure, return figure, accuracy percentage, success rate, or historical result testing in connection with any India Track indicator. None is offered, and none forms part of the Scope.
2.4.2 Accordingly, no remedy on this Track is linked to any result, outcome or measurement of any kind. The remedies on this Track are correction of display defects and nothing else.
Part B
Global Track
Applies to licensed trading software supplied to international clients.
3.1 Ready-Made Products — Try Before You Buy
3.1.1 Where SKEPTIX offers a demonstration version of a ready-made product, you may use it to evaluate the product before purchasing, on a demonstration account or on a live account with a small amount of capital you are prepared to risk. The demonstration version may be time-limited, function-limited, or restricted to particular conditions — what it includes is stated at the point of download.
3.1.2 Because you are able to evaluate before purchasing, a full licence purchased after a demonstration is non-refundable once delivered or activated, subject to Clauses 3.1.3 and 5.
3.1.3 Defect remedy. If a purchased product materially fails to perform the core functions described for it, notify SKEPTIX in writing within 14 days of delivery with enough detail to reproduce the issue. SKEPTIX will use reasonable efforts to correct a genuine defect. If it cannot be corrected within a reasonable period, SKEPTIX refunds the licence fee for that product.
3.1.4 Where no demonstration version is offered for a particular product, SKEPTIX offers a refund within 7 days of delivery if the product materially fails to perform the core functions described for it and cannot be corrected.
3.1.5 Evaluate first. You are strongly encouraged to use the demonstration version before buying, where one is offered. Once you buy without evaluating, and the product performs as described, the purchase stands.
3.2 Custom Strategy Development
| Stage | Amount | When |
|---|---|---|
| Advance | 50% | On confirmation of the written Scope, before development begins |
| Balance | 50% | On delivery of the completed product, before final files are released |
3.2.1 No refund after delivery. Once a custom strategy has been built to the confirmed Scope and delivered, the fee is not refundable. The 50% advance is non-refundable once development has commenced; if you cancel before development begins, it is refunded in full less any transfer charge.
3.2.2 We build what you specify — we do not warrant what it earns. You are commissioning SKEPTIX to write code that implements the rules you have specified. SKEPTIX is responsible for implementing those rules correctly, accurately and completely. SKEPTIX is not responsible for whether the rules themselves are profitable — that depends on the rules, the market, the instrument, the broker, the settings, the risk applied, and conditions entirely outside our control. Accordingly, no refund is available on the ground that a custom strategy was not profitable, was loss-making, or did not perform as you hoped.
3.3 Goodwill Remedy Where Historical Testing Is Unfavourable
3.3.1 This clause is a discretionary goodwill gesture, offered because SKEPTIX would rather you left the engagement with something useful than with nothing. It is not a performance guarantee, not a warranty of results, and not an admission that SKEPTIX is responsible for the profitability of any strategy.
3.3.2 When it applies. This clause may apply where all of the following are true: the engagement is a custom strategy build on the Global Track; SKEPTIX has implemented your rules correctly and completely in accordance with the confirmed Scope; historical testing of the completed strategy, carried out by SKEPTIX using the instrument, timeframe and test period agreed and recorded in the Scope, produces a net negative result over that period; and you raise the matter in writing within 14 days of delivery.
3.3.3 What is offered. Where Clause 3.3.2 is satisfied, SKEPTIX will, at its discretion: waive 20% of the total fee for that engagement (applied as a credit against your next engagement, valid for 12 months, if the fee has already been paid in full); and supply, at no charge, one complimentary ready-made Global Track indicator from the then-current SKEPTIX range, licensed on the standard single-user terms.
3.3.4 No cash refund. This clause does not entitle you to any refund of money paid. The 20% is a fee waiver or a credit, and the indicator is a complimentary licence. No cash is returned under this clause in any circumstances. This remedy is available once per engagement.
3.3.5 Historical testing is not a prediction. Any historical test is a calculation applied to past data. It is not actual trading, and is designed with the benefit of hindsight. A favourable historical test does not indicate future results, and an unfavourable one does not mean the code is defective.
3.4 Licence and Activation
3.4.1 Where a product is bound to a trading account number or activation limit, SKEPTIX provides up to two re-activations free of charge where you genuinely change hardware, reinstall your system, or change trading account. Further re-activations are at SKEPTIX’s discretion and may be chargeable.
3.4.2 No refund arises from your having exhausted activations, changed broker, or closed the account to which a licence was bound.
Part C
Web Development Track
Applies to website design, development, e-commerce, landing page and related services.
4.1 Payment Schedule
| Stage | Amount | When |
|---|---|---|
| Advance | 50% | On confirmation of the written Scope, before work begins |
| Midpoint | 25% | On approval of the design or delivery of the staging build, as stated in the Scope |
| Completion | 25% | On completion of the work, before launch and before source code release |
4.1.1 Work does not begin until the advance is received. SKEPTIX may pause work if any milestone payment is overdue, and is not responsible for delay caused by that pause.
4.2–4.3 Fixed Price and Chargeable Extras
4.2.1 The total fee stated in the accepted quotation is fixed for the work described in it. Anything not listed in the quotation is not included in the fee.
4.3.1 The following are change requests, quoted and charged separately, in addition to the agreed fee: any feature or page not in the original quotation; any change of design direction after a concept has been approved; any new functionality or third-party integration added after the Scope was confirmed; e-commerce, booking, payment, membership or login functionality not originally included; and content writing, photography, logo or brand design unless expressly included.
4.3.2 No change request is started until it is quoted in writing and approved by you in writing. Revisions are not change requests — the fee includes two rounds of revisions per major deliverable, refining work already produced within the agreed Scope.
4.4 Bug Fix Period
4.4.1 SKEPTIX provides a 30-day bug fix period from the date of launch, at no additional charge, covering genuine build defects — anything that does not work as described in the confirmed Scope.
4.4.2 The bug fix period does not cover: new features or changes of any kind; content changes or updates; faults in third-party themes, plugins, platforms or hosting; problems from changes you or a third party made after handover; or issues from your failure to maintain, update or back up the site.
4.4.3 After 30 days, support and maintenance are available under a separate written arrangement, quoted separately.
4.5–4.6 Domain, Hosting and Source Code
4.5.1 Domain registration and hosting are your cost and your responsibility, not included in the development fee unless the quotation expressly says so. We recommend registering these in your own name so you retain full control.
4.6.1 Source code, design files and all project assets are released only after 100% of the agreed fee has been received. Until then, SKEPTIX retains ownership of all work produced and you have no licence to deploy or use it commercially.
4.7–4.8 Refund Position and Client Delay
4.7.1 The 50% advance is non-refundable once work has commenced. No refund is available for work already performed — on cancellation, you pay for all work completed to date, calculated by reference to the milestones reached. If you cancel before work commences, the advance is refunded in full less any transfer charge. If SKEPTIX cancels for any reason other than your breach, SKEPTIX refunds all sums paid for work not performed.
4.7.2 No refund arises from: delays caused by your late supply of content, feedback or approvals; a change of business plan; dissatisfaction with a design previously approved in writing; or any search ranking, traffic, conversion or commercial outcome, none of which is promised.
4.8.1 If a project is delayed by you for more than 30 days through non-supply of content, feedback or approvals, SKEPTIX may treat it as suspended, invoice for work completed to date, and reallocate capacity. Resuming a suspended project may attract a reasonable re-mobilisation charge, quoted in advance.
5. Consumers in the European Union and United Kingdom
5.1 This Clause applies only if you are a consumer resident in the EU or UK, purchasing for purposes outside your trade or business. It does not apply to business customers.
5.2 You have a 14-day right to cancel a distance purchase of digital content, without giving a reason. This right is lost once supply begins, if before supply began you expressly consented to immediate supply and acknowledged that you would thereby lose the right to cancel.
5.3 Statutory quality rights. Regardless of anything else in this Policy, digital content supplied to you must be of satisfactory quality, fit for any purpose you made known to us before purchase, and as described. If it is not, you are entitled to have it brought into conformity and, where that is not done within a reasonable time and without significant inconvenience, to an appropriate price reduction or to terminate and receive a refund. Nothing in this Policy limits those rights.
5.4 Refunds due under this Clause are paid within 14 days of our receiving your notice, using the same payment method you used.
6. What Is Never Refundable
6.1 For clarity, no refund is available in any of the following circumstances, on any Track:
- the product did not produce a profit, a return, or any particular result;
- you changed your mind after work commenced;
- you changed your requirement, method, market, broker or business plan;
- you were unable or unwilling to install, configure, use or maintain what was delivered;
- your device, platform, subscription, data feed, hosting or internet connection was inadequate;
- you did not read the Scope or quotation before approving it;
- you approved a design or a build and later changed your preference;
- a third-party platform, broker, exchange or service changed its rules, pricing or availability;
- you breached the Terms and Conditions and the engagement was terminated;
- you shared, resold or redistributed a Deliverable in breach of your licence; or
- work was already performed and delivered in accordance with the confirmed Scope.
7. How to Request a Refund or Raise a Concern
7.1 How. Write to supportskeptix@gmail.com or message the WhatsApp number published on the Website.
7.2 What to include. Your name; the Order or invoice reference; the date of purchase or delivery; and a clear description of the issue, with screenshots, settings or logs where relevant.
7.3 Acknowledgement. SKEPTIX acknowledges every request within 48 hours.
7.4 Assessment and decision. SKEPTIX assesses the request against the confirmed Scope and this Policy, and communicates its decision in writing within 7 working days of receiving all necessary information. We will not decline a request without explaining why.
7.5 Payment of an approved refund. Approved refunds are paid within 14 days, to the original payment source where possible. Payment gateway charges, bank transfer charges, remittance fees and currency conversion costs already incurred are deducted from any refund.
7.6 Escalation. If you are not satisfied with the outcome, raise it with our Grievance Officer, whose details and timelines are set out in our Terms and Conditions. Every grievance is acknowledged within 48 hours and resolved within one month.
8. Chargebacks
8.1 If you have a concern, raise it with us first — we will always try to resolve it. Raising a chargeback or payment dispute without first contacting us, in respect of a Deliverable supplied in accordance with the confirmed Scope, is a breach of the Terms and Conditions.
8.2 Where a chargeback is raised in such circumstances, SKEPTIX may immediately suspend or revoke any licence issued, withdraw platform access, suspend all work in progress, and recover the amount together with any related charge.
9. Changes to This Policy
9.1 SKEPTIX may update this Policy. The current version is published on the Website with its effective date.
9.2 The version in force on the date your Order was accepted is the version that applies to that Order. A later change does not retrospectively alter the terms of an Order already accepted.
